Ohoon Kwon, Refusing to Provide Medical Records Is Illegal… A Violation of Patients’ Righ

In response to a case where a patient who suffered complications from cosmetic surgery was denied access to their medical records, Attorney Ohoon Kwon of Cha & Kwon Law Offices stated that the hospital's actions constitute a clear violation of the Medical Service Act.
Attorney Kwon emphasized, “Visiting another hospital first is not a legitimate reason to refuse treatment,” and pointed out that such actions may be subject to criminal penalties under Article 89 of the Act.
He further clarified, “A doctor’s consent is not a legal requirement for a patient to access their own medical records,” underscoring the hospital's unlawful conduct.
This case illustrates how securing medical records is the first and most crucial step in pursuing a medical malpractice lawsuit, and experts recommend sending a content-certified letter from an attorney as an effective first action.
